WinSpirit Conditions for Accounts, Access and Member Conduct
Acceptance of the WinSpirit Service Rules
By using WinSpirit, registering an account, signing in, making a payment, requesting a withdrawal, placing a wager or using any related service, you agree to follow these Terms & Conditions. These Terms apply together with any product rules, promotion terms, privacy notices, responsible gambling settings and account instructions made available through the website.
If you do not agree with these Terms, you must not use WinSpirit or continue with account activity. Continued use after updated Terms are published may be treated as acceptance of the revised version, subject to applicable law.
These Terms apply to users in Australia where access to the service is available and not restricted. Certain features, payment methods, products, rewards or account settings may depend on location, verification status, service availability and account history.
Who May Use a WinSpirit Account
You must meet the legal age requirement that applies in your location and must be legally permitted to access and use the service from where you are based. It is your responsibility to confirm that your use of WinSpirit is allowed under the rules that apply to you.
WinSpirit may refuse registration, limit account access or close an account where eligibility cannot be confirmed, where the information provided is incomplete or inaccurate, or where use of the service appears inconsistent with these Terms.
Website availability does not mean that every person may register, deposit or use every function. Access may be restricted by territory, account status, verification requirements or operational controls.
Account Registration and Personal Responsibility
A WinSpirit account must be registered in the name of the person who uses it. You must not create an account for another person, use another person’s details, share login credentials, transfer account access or allow someone else to operate your account.
The information you provide during registration, verification, payment activity or contact with support must be accurate, current and complete. If your details change, you may be required to update them or provide supporting information before continued use of the account.
Only one account may be permitted per person unless WinSpirit confirms otherwise. Duplicate, linked, false or misleading accounts may be reviewed, restricted or closed, particularly where they are connected to payment concerns, bonus misuse, verification issues or attempts to bypass account rules.
WinSpirit Verification and Account Review
WinSpirit may request information or documents to confirm identity, age, address, account ownership, payment method ownership, source of funds or other details relevant to account use. Verification may be required at registration, before withdrawals, after unusual activity or at any other stage where review is needed.
If requested information is not provided, cannot be verified or appears inconsistent, account functions may be delayed, restricted, suspended or closed. Withdrawals, account changes, payments, promotions and continued access may be affected until the review is complete.
Account records, transaction history, login data, technical records and communication history may be used to assess risk, investigate concerns, prevent misuse and protect the integrity of the service.
Payments, Withdrawals and Balance Handling
Deposits and withdrawals must be made through payment methods accepted for the account and, where required, held in the name of the registered account holder. Available methods, limits, fees and processing conditions may vary depending on location, payment provider, account status and verification outcome.
Withdrawals may be reviewed before approval. Processing times can depend on the chosen method, provider handling, account checks, transaction history, technical availability and whether additional information is required.
WinSpirit may delay, decline, reverse or review a transaction where there is a valid reason, including suspected fraud, payment misuse, chargebacks, unauthorised payment use, technical error, incomplete verification or breach of these Terms. Balances linked to prohibited activity may be adjusted or withheld in accordance with applicable rules and requirements.
Game Activity, Wagers and System Records
All games, wagers, results, rewards and related activity are subject to the rules of the relevant product or service. You are responsible for reviewing applicable rules before taking part in activity that may affect your account balance or withdrawal eligibility.
If there is a difference between what appears on screen and verified system records, WinSpirit may rely on server records, game logs, transaction data or other technical records to determine the correct outcome, subject to applicable law and review procedures.
Technical faults, connection interruptions, incorrect displays, software errors, malfunctioning games, mispriced activity or unauthorised interference may result in affected activity being corrected, cancelled or reviewed. WinSpirit is not required to honour results, balances or rewards created by error or improper use.
Conduct Not Accepted by WinSpirit
You must use WinSpirit lawfully, honestly and in accordance with these Terms. Prohibited conduct includes fraud, identity misuse, account sharing, duplicate account creation, collusion, use of stolen or unauthorised payment methods, exploitation of errors, promotion abuse, automation, bots, scraping, hacking or interference with website systems.
You must not conceal your location, provide misleading information, bypass verification, avoid responsible gambling restrictions or use the account in a way that harms other users, payment providers, service partners or the operation of the website.
Where prohibited activity is suspected, WinSpirit may review the account, request further information, suspend withdrawals, cancel affected activity, remove rewards, restrict access or close the account.
Promotions, Rewards and Offer-Specific Conditions
Promotions, rewards, bonuses or similar offers may be governed by separate terms. These conditions may include eligibility rules, expiry dates, wagering requirements, payment restrictions, product limits, maximum values or other offer-specific requirements.
Where offer-specific terms apply, they form part of the agreement between you and WinSpirit. If there is a conflict between these Terms and the rules of a particular offer, the offer-specific rules may apply to that promotion unless stated otherwise.
WinSpirit may refuse, amend, cancel or recover a reward where eligibility has not been met, where an offer has been used incorrectly, where a technical or administrative error has occurred, or where account activity indicates misuse.
Responsible Gambling Measures and Restricted Access
WinSpirit may make responsible gambling controls available depending on account settings, location and service availability. These may include limits, pauses, temporary restrictions, exclusion options or other controls intended to help users manage activity.
If a responsible gambling measure is active, you must not attempt to bypass it by opening another account, using someone else’s account, changing personal details or accessing the service through indirect means. Any attempt to avoid an active restriction may lead to account closure and review of related transactions.
WinSpirit may take action where account activity raises responsible gambling concerns, security concerns or signs of harmful use. This may include limiting access, requesting information, applying account controls or directing the user toward available support options.
Suspending, Restricting or Closing a WinSpirit Account
WinSpirit may suspend, restrict or close an account where there is a breach of these Terms, suspected fraud, failed verification, payment dispute, underage access, prohibited conduct, security risk, responsible gambling concern, inactivity or another valid operational or legal reason.
You may request account closure where that option is available. Before closure is completed, open transactions, unresolved complaints, verification matters, responsible gambling settings or compliance checks may need to be reviewed.
If an account is restricted or closed, access to balances, pending activity or rewards will depend on the reason for the action, applicable rules and the outcome of any review. Certain records may be retained after closure where needed for security, accounting, fraud prevention, dispute handling, payment records or responsible gambling controls.
Complaints, Records and Review Process
If you wish to raise a complaint, you should provide clear information about the matter, including relevant dates, account details, transaction references, game activity, communications or other supporting information where available.
WinSpirit may assess a complaint using account records, technical logs, payment information, product rules, communication history and the Terms that applied at the time of the activity. Further information may be requested before a matter can be reviewed fully.
The outcome of a review will depend on the available records, applicable rules and the specific circumstances of the case. Some matters may require additional time where payment providers, technical records, verification checks or account security reviews are involved.
Website Materials, Service Changes and Legal Effect
The WinSpirit name, website content, graphics, text, design, software, systems, logos and related materials are owned by or licensed to WinSpirit or its relevant partners. You receive only a limited, personal, revocable and non-transferable right to use the service in accordance with these Terms.
You must not copy, modify, distribute, reproduce, sell, reverse engineer, exploit or interfere with website materials or systems unless expressly permitted. Unauthorised use may result in account action and other remedies where available.
WinSpirit may update these Terms from time to time to reflect changes in service operations, technology, security needs, product availability or applicable requirements. The updated version applies from publication or from any stated effective date.
To the extent permitted by applicable law, WinSpirit is not responsible for losses caused by user error, unauthorised account use, technical interruption, third-party delay, payment provider issues, breach of these Terms or events outside reasonable control. Nothing in these Terms excludes liability that cannot legally be excluded.
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue to apply. A delay in enforcing a right does not prevent WinSpirit from enforcing that right later. These Terms are interpreted subject to applicable law and any mandatory protections available to users in Australia.
